The Tobacco Products Directive Evaluation and the Illicit Market — FGGK's Position
The European Commission has evaluated the EU's tobacco-control framework. Our firm submitted its position in the public feedback procedure.
In 2025, the National Revenue Administration (KAS) conducted nationwide inspections of the disposable e-cigarette and replaceable cartridge market with e-liquid.
The focus was on producers, importers, and entities involved in intra-Community acquisitions, verifying compliance with excise and health protection regulations.
A total of 1,388 product samples were tested. In 83.9% of cases (1,164 samples), the tank capacity exceeded the permitted 2 ml limit, breaching the Tobacco and Health Protection Act. Additionally, 24.9% of samples had understated e-liquid volumes, enabling excise tax evasion. Packaging often lacked mandatory health warnings.
As a result, KAS filed 50 reports to the Police and Prosecutor’s Office over suspected violations. These actions aim to curb the gray market and protect consumers, with further inspections planned.
